La posesión de los menores de edad y la prescripción adquisitiva de dominio en el Perú

Abstract

Al desarrollar este trabajo de investigación, busco la regulación de una adecuada y precisa interpretación sobre la posesión de los menores de edad, garantizando de esta manera, la adquisición que fue originada de la propiedad a través de la usucapión. Y para alcanzar este objetivo, el diseño de la presente investigación es transeccional descriptiva, de tipo socio jurídica, por cuánto se desarrollará una casación, analizando el marco teórico, doctrinario y práctico. Siendo que en el primer capítulo trataremos sobre aspectos metodológicos, en el segundo capítulo, sobre marco teórico para luego en el capítulo siguiente, tratar sobre el análisis y resultados; todo ello nos llevará a tener una conclusión respectiva que nos permitirá verificar la viabilidad de la propuesta planteada.

When developing this research work, I seek the regulation of an adequate and precise interpretation of the possession of minors, thus guaranteeing the acquisition that originated from the property through usucapion. And to achieve this objective, the design of the present investigation is transectional descriptive, of a socio-legal type, for how much an appeal will be developed, analyzing the theoretical, doctrinal and practical framework. Being that in the first chapter we will deal with methodological aspects, in the second chapter, on theoretical framework and then in the next chapter, deal with the analysis and results; all this will lead us to have a respective conclusion that will allow us to verify the feasibility of the proposed proposal.
