Análisis de la implementación de los convenios de la OIT y la CIPTMF frente a la protección de los derechos laborales de los trabajadores migrantes

Abstract

Los trabajadores migrantes son aquellas personas que prestan servicios remunerados en un Estado en el que no poseen nacionalidad. A pesar de la existencia de convenios internacionales en materia de protección de derechos laborales, los trabajadores migrantes son expuestos a situaciones de riesgo, tales como la explotación y discriminación laboral. Así, debido a la posición vulnerable y necesidad de protección efectiva del trabajador migrante, resulta importante analizar si existen barreras que obstaculizan la aplicación efectiva de los derechos laborales de los trabajadores migrantes en el ámbito nacional, a fin de proponer estrategias que permitan superar estas dificultades. Por ende, la investigación tiene como objetivo evaluar la efectividad de la implementación de los Convenios de la OIT y de la Convención Internacional sobre la Protección de los Derechos de todos los Trabajadores Migratorios y de sus Familiares (CIPTMF), en el ordenamiento peruano, respecto a la protección de los derechos laborales de los trabajadores migrantes. Para alcanzar este objetivo, se empleó una metodología hipotética deductiva, a fin de analizar la coherencia entre la legislación nacional y los estándares internacionales sobre los derechos laborales de los trabajadores migrantes. Como resultado de la investigación se obtuvo que la efectividad de la implementación de las normas internacionales en el ordenamiento peruano se ve limitada por la falta de armonización entre la normativa nacional y los estándares internacionales.

Migrant workers are those people who provide paid services in a State in which they do not have nationality. Despite the existence of international agreements on the protection of labor rights, migrant workers are exposed to risk situations, such as labor exploitation and discrimination. Thus, due to the vulnerable position and need for effective protection of the migrant worker, it is important to analyze whether there are barriers that hinder the effective application of the labor rights of migrant workers at the national level, in order to propose strategies that allow overcoming these difficulties. Therefore, the research aims to evaluate the effectiveness of the implementation of the ILO Conventions and the International Convention on the Protection of the Rights of All Migrant Workers and Their Families (CIPTMF), in the Peruvian system, with respect to the protection of the labor rights of migrant workers. To achieve this objective, a hypothetical deductive methodology was used to analyze the coherence between national legislation and international standards on the labor rights of migrant workers. As a result of the investigation, it was found that the effectiveness of the implementation of international standards in the Peruvian legal system is limited by the lack of harmonization between national regulations and international standards.
