Análisis de la declaratoria de fábrica en terreno propio de uno de los cónyuges a la luz del Pleno CCXX registral

Abstract

En esta investigación se planteó como objetivo general determinar si el Pleno CCXX registral interpretó adecuadamente la calidad de la declaratoria de fábrica en terreno propio de uno de los cónyuges y mediante los objetivos específicos se ha buscado estudiar los bienes propios y bienes sociales según el Código Civil, determinar a través del estudio de las resoluciones del Tribunal Registral cuáles son los criterios que aplica en la inscripción de la declaratoria de fábrica sobre bien propio de uno de los cónyuges y proponer un criterio de aplicación para la inscripción de la declaratoria de fábrica sobre bien propio de uno de los cónyuges. Se logró comprobar que, si se tiene en cuenta que la inscripción de la declaratoria de fábrica no varía la naturaleza jurídica del suelo, se debe modificar mediante otro Pleno registral la interpretación que se le da a los artículos 310 del Código Civil y 79 del Reglamento de Inscripciones del Registro de Predios impuesto en el Pleno CCXX. El tipo de investigación fue básica y el diseño no experimental, de corte transversal, descriptivo y correlacional. Se empleó el método inductivo-deductivo, analítico, estadístico y descriptivo. La técnica empleada fue la encuesta y el instrumento fue el cuestionario.

The general objective of this research was to determine if the Plenary CCXX Registry adequately interpreted the quality of the declaration of factory on land belonging to one of the spouses and through the specific objectives it has been sought to study the own property and social property according to the Civil Code, to determine through the study of the resolutions of the Registry Court which are the criteria applied in the registration of the declaration of factory on property belonging to one of the spouses and to propose an application criterion for the registration of the declaration of factory on property belonging to one of the spouses. It was found that, if it is taken into account that the registration of the declaration of factory does not change the legal nature of the land, the interpretation given to articles 310 of the Civil Code and 79 of the Regulation of Inscriptions of the Real Estate Registry imposed in the CCXX Plenum should be modified by another Registry Plenum. The type of research was basic and the design was non- experimental, cross-sectional, descriptive and correlational. The inductive- deductive, analytical, statistical and descriptive method was used. The technique used was the survey and the instrument was the questionnaire.
