Las restricciones del libre desarrollo de la personalidad para postular a las escuelas de la Policía Nacional del Perú

Abstract

El estudio tuvo como objetivo determinar si las restricciones establecidas para postular a las Escuelas de la Policía Nacional del Perú, por ser casados y tener hijos, afectan el derecho al libre desarrollo de la personalidad. El estudio fue aplicado mediante enfoque cualitativo, se contrastó las opiniones de abogados especializados en derecho constitucional a fin de conocer si consideran que los requisitos establecidos en el art. 70-A inc. 1.3 del D.S. 22-2017/IN vulneran el derecho al libre desarrollo de la personalidad y, se analizó las sentencias del Tribunal Constitucional sobre la no admisión de postulantes y sobre la separación definitiva de alumnos y cadetes de las Escuelas de Instrucción de la Policía Nacional, por ser casados y tener hijos. Las técnicas aplicadas fueron la entrevista y el análisis documental. Los instrumentos utilizados fueron la guía de entrevista y la guía de análisis documental. En los resultados se advierte que lasrestricciones establecidas para postular a las Escuelas de la Policía Nacional del Perú, porser casados y tener hijos, afectan el derecho al libre desarrollo de la personalidad. Se concluye que se debe modificar el artículo 70-A inciso 1.3 del Decreto Supremo N.° 022-2017-IN, para garantizar el derecho al libre desarrollo de la personalidad de los postulantes a las Escuelas de Instrucción de la Policía Nacional del Perú, pues permitirá que las personas casadas con hijos o sin hijos y los solteros con hijos postulen a las escuelas policiales.

The objective of the study was to determine whether the restrictions established to apply to the schools of the National Police of Peru, for being married and having children, affect the right to the free development of personality. The study was applied through qualitative approach, the opinions of lawyers specialized in constitutional law were contrasted in order to know if they consider that the requirements established in art. 70-A inc. 1.3 of D.S. 22-2017/IN violate the right to the free development of personality and, the sentences of the Constitutional Court on the non-admission of applicants and on the definitive separation of students and cadets from the National Police training schools, for being married and having children, were analyzed. The techniques applied were interviews and documentary analysis. The instruments used were the interview guide and the documentary analysis guide. The results show that the restrictions established to apply to the schools of the National Police of Peru, for being married and having children, affect the right to free development of the personality. It is concluded that Article 70- A paragraph 1.3 of Supreme Decree No. 022-2017-IN should be modified to guarantee the right to free development of the personality of applicants to the Schools of Instruction of the National Police of Peru, since it will allow married people with children and single people with children to apply to the police schools.
