La interpretación jurisdiccional de la subjetividad del agente en el homicidio calificado por ferocidad frente al reconocimiento de la responsabilidad penal

Abstract

Esta investigación se basa en la interpretación jurisdiccional de la subjetividad del agente en el homicidio calificado por ferocidad frente al reconocimiento de la responsabilidad penal, es decir, a la subsunción de un hecho delictivo que realizan los intérpretes de impartir justicia en el Perú y específicamente en nuestro distrito judicial de Lambayeque, concretamente la subsunción del homicidio calificado por ferocidad, distinguiéndolo de las demás tipologías que nos muestra nuestro catálogo penal, como el homicidio calificado con gran crueldad, homicidio con alevosía, o el tipo base como lo es el homicidio simple que muchos intérpretes de justicia se esmeran en confundir, es así que, nos centraremos en realizar un correcto análisis de las sentencias referente a la subjetividad del agente en el homicidio calificado por ferocidad para deslindarlas de las demás tipologías realizando así una adecuada interpretación jurisdiccional del homicidio calificado por ferocidad, mejorando así a la hora de decidir, la imposición de la reprochabilidad que se le impone a un imputado, respetando siempre el principio de legalidad.

This research is based on the jurisdictional interpretation of the subjectivity of the agent in homicide qualified by ferocity versus the recognition of criminal responsibility, that is, the subsumption of a criminal act carried out by the interpreters of dispensing justice in Peru and specifically in our judicial district of Lambayeque, specifically the subsumption of homicide qualified by ferocity, distinguishing it from the other typologies that our criminal catalog shows us, such as qualified homicide with great cruelty, homicide with treachery, or the basic type such as simple homicide that many interpreters of justice try to confuse, so we will focus on carrying out a correct analysis of the sentences regarding the subjectivity of the agent in the case. homicide qualified by ferocity to separate them from the other typologies, thus carrying out an adequate jurisdictional interpretation of homicide qualified by ferocity, thus improving, when deciding, the imposition of the blameworthiness that is imposed. imposes on an accused, always respecting the principle of legality.
