Eficacia de la investigación del delito de agresiones en contra de las mujeres e integrantes del grupo familiar en la modalidad de afectación psicológica. Nueva Cajamarca, 2021

Abstract

El presente estudio tuvo como objetivo identificar la eficacia de la investigación por el delito de agresiones en contra de las mujeres e integrantes del grupo familiar en la modalidad de afectación psicológica en la Segunda Fiscalía Penal Corporativa de Nueva Cajamarca en el periodo 2021. Esta investigación mantuvo una tipología de investigación básica de enfoque cuantitativo, nivel descriptivo correlacional con un diseño no experimental, su población de estudio estuvo constituida por carpetas fiscales con disposiciones fiscales por delito de agresiones en contra de las mujeres o integrantes del grupo familiar que se tramitaron en dicha Fiscalía, que alcanzaron 40 disposiciones fiscales. Las técnicas aplicadas fueron la técnica de observación, entrevista y el análisis documental, como instrumentos tenemos la ficha de observación, de entrevista y la guía de análisis documental. Los resultados mostraron que resultó ineficaz la manera en que la Segunda Fiscalía Penal Corporativa de Nueva Cajamarca realizó la investigación del delito de agresiones en contra de las mujeres o integrantes del grupo familiar en la modalidad de afectación psicológica en el año 2021, ello debido a que no contó con el personal y la logística idónea y suficiente. Por lo que se recomienda que dicha entidad debe fortalecer sus capacidades operativas, logística y de personal.

The objective of this study was to identify the effectiveness of the investigation for the crime of assaults against women and members of the family group in the modality of psychological affectation in the Second Corporate Criminal Prosecutor’s Office of Nueva Cajamarca in the period 2021. This research maintained a basic research

typology of quantitative approach, descriptive correlational level with a non- experimental design, its study population was constituted by fiscal files with fiscal

dispositions for the crime of Violence against women and members of the family group that were processed in said Prosecutor's Office, which reached 40 fiscal dispositions. The techniques applied were observation, interview and documentary analysis, and the instruments used were the observation and interview forms and the documentary analysis guide. The results showed that the manner in which the Second Corporate Criminal Prosecutor’s Office of Nueva Cajamarca conducted the investigation of the crime of aggression against women and members of the family group in the modality of psychological affectation in the year 2021 was ineffective, due to the fact that it did not have the appropriate and sufficient personnel and logistics. Therefore, it is recommended that this entity should strengthen its operational, logistical and personnel capacities.
