La repercusión procesal de la logística para Cámara Gesell por violación sexual y la responsabilidad estatal del interés superior del niño

Abstract

La tesis “La repercusión procesal de la logística para Cámara Gesell por violación sexual y la responsabilidad estatal del interés superior del niño”, se ha desarrollado aplicando el método lógico y de interpretación jurídica, a través de los cuales se estableció como resultado que el problema no corresponde únicamente al campo administrativo, dado que se vincula con la eficacia y justicia propiamente; pues afecta la celeridad, la imparcialidad, equidad y justicia. En tal sentido la entrevista única por Cámara Gesell en los casos de violación sexual de menores compatibiliza el derecho a la verdad y la no revictimización, haciendo falta el control de estándares de rigor y propiciando mayor capacitación a quienes se encargan de la operatividad. Habiéndose denotado limitación logística verificada del sistema de justicia en Celendín produce un efecto negativo sore la eficaz y oportuna ejecución de la entrevista realizada en Cámara Gesell, demora que termina por vulnerar la condición de rapidez y urgencia de los procesos, así como también altera el derecho de las víctimas dada su minoría de edad.

The thesis "The procedural impact of logistics for the Gesell Chamber for sexual assault and the state's responsibility for the best interests of the child" was developed by applying logical and legal interpretation methods. The results established that the problem is not solely administrative, as it is linked to efficiency and justice itself; it affects speed, impartiality, equity, and justice. In this sense, the single interview conducted by the Gesell Chamber in cases of sexual assault of minors makes compatible the right to the truth and non-revictimization, requiring the control of rigorous standards and the provision of greater training for those responsible for its operation. The verified logistical limitations of the justice system in Celendín have a negative impact on the efficient and timely execution of the interviews conducted in the Gesell Chamber. This delay ultimately violates the conditions for speed and urgency of the proceedings, as well as impairs the rights of the victims given their minority status.
