El concubinato y la atribución de la responsabilidad civil producto de obligaciones frente a terceros

Abstract

El concubinato en el Perú se encuentra reconocido y regulado tanto en la Constitución Política del Perú como también en el Código Civil, las mismas que refieren que es la unión estable de un varón y una mujer, libres de impedimento matrimonial, que forman un hogar de hecho por más de dos años consecutivos; la cual da lugar a una comunidad de bienes sujeta al régimen de la sociedad de gananciales con la finalidad cumplir deberes semejantes a los del matrimonio. El propósito de este estudio es determinar la existencia de responsabilidad civil de obligaciones generadas frente a terceros en el concubinato. El estudio fue de tipo básico, con enfoque cualitativo, utilizando como herramienta la entrevista, a cinco abogados especializados en derecho civil. Se concluyó que, si bien nuestra normativa actualmente reviste de derechos y deberes semejantes a las del matrimonio al concubinato, esta no ha materializado normativamente las obligaciones que estas deban tener frente a terceros ni la responsabilidad de estas.

Cohabitation in Peru is recognized and regulated both in the Political Constitution of Peru as well as in the Civil Code, which refer that it is the stable union of a man and a woman, free of matrimonial impediment, who form a de facto household for more than two consecutive years; which gives rise to a community of property subject to the regime of community of property with the purpose of fulfilling duties similar to those of marriage. The purpose of this study is to determine the existence of civil liability for obligations generated before third parties in the cohabitation. The study was of a basic type, with a qualitative approach, using as a tool the interview of 05 lawyers specialized in civil law. It was concluded that, although our legislation currently provides cohabitation with rights and duties similar to those of marriage, it has not materialized normatively the obligations that these should have before third parties nor the liability of these.
