Criterios Jurídicos para determinar la Reparación Civil en los delitos de violación a la libertad sexual en el primer y segundo Juzgado Penal Colegiado del distrito judicial de Lambayeque durante el periodo 2015 al 2016

Abstract

La presente investigación: “CRITERIOS JURÌDICOS PARA DETERMINAR LA REPARACION CIVIL EN LOS DELITOS DE VIOLACIÓN A LA LIBERTAD SEXUAL EN EL PRIMER Y SEGUNDO JUZGADO PENAL COLEGIADO DEL DISTRITO JUDICIAL DE LAMBAYEQUE DURANTE EL PERIOO 2015 AL 2016”, es un trabajo de investigación que surge a raíz de la necesidad de conocer si los criterios jurídicos se están aplicando en forma adecuada para fijar montos de la reparación civil a través de las sentencias emitidas por parte de los operadores de justicia, por lo que se planteó como problema de investigación ¿La carencia de criterios jurídicos adecuados, no permite determinar en forma correcta la reparación civil en los delitos de violación a la libertad sexual en el Primer y Segundo Juzgado Penal Colegiado del Distrito Judicial de Lambayeque durante el periodo 2015 al 2016?, siendo el objetivo general: Determinar la existencia de criterios jurídicos adecuados para la fijar la reparación civil en los delitos de violación a la libertad sexual en el Primer y Segundo Juzgado Penal Colegiado del Distrito Judicial de Lambayeque. La presente investigación corresponde a una Investigación Fundamental o básica que se llevara a cabo con las sentencias correspondientes al Primer y Segundo Juzgado Penal Colegiado de Chiclayo, las mismas que servirán como fuente para analizar el criterio de racionalidad, coherencia, razonabilidad y proporcionalidad de los jueces en la determinación de la reparación civil de las víctimas; así mismo la hipótesis de investigación planteada es: La carencia de criterios jurídicos adecuados no permite en forma justa y razonable determinar la reparación civil en los delitos de violación a la libertad sexual en el Primer y Segundo Juzgado Penal Colegiado del Distrito Judicial de Lambayeque durante el periodo 2015 al 2016. Para el desarrollo de la investigación se elaboró un instrumento que permita medir los criterios jurídicos, así como la reparación civil teniendo en cuenta sus indicadores, correspondientes. Así mismo se orienta en la presente investigación proponer técnicas que ayuden a los operadores de justicia a aplicar correctamente los criterios jurídicos en los delitos de violación a la libertad sexual a través de las sentencias

The lack of adequate legal criteria does not allow the correct determination of civil remedies in the crimes of violation of sexual freedom in the first and second collegiate courts of the judicial district of Lambayeque during the period 2015 to 2016?, the general objective being: To determine the existence of adequate legal criteria for fixing civil remedies for crimes of rape against the sexual freedom in the first and second collegiate court of the judicial district of Lambayeque. The present investigation corresponds to a Fundamental or Basic Investigation that will be carried out with the sentences corresponding to the first and second collegiate criminal court of Chiclayo, the same ones that will serve as a source to analyze the criterion of rationality, coherence, reasonableness and proportionality of the judges. in determining the civil damages of the victims; likewise the research hypothesis is: The lack of adequate legal criteria does not allow a fair and reasonable way to determine the civil compensation in the crimes of violation of sexual freedom in the first and second collegiate court of the judicial district of Lambayeque during the period 2015 to 2016. For the development of the research, an instrument was developed to measure legal criteria, as well as civil compensation, taking into account its corresponding indicators. Likewise it is oriented in the present investigation to propose techniques that help the operators of justice to apply correctly the legal criteria in the crimes of violation to the sexual freedom through the sentences
