La separación de poderes desde la óptica constitucional peruana

Abstract

La separación de poderes resulta un elemento vital en todo estado constitucional de derecho, es por ello que, desde la aparición de la teoría del estado moderno hasta nuestros días, los estados han tratado de garantizar dicha licuación del poder, con la finalidad de evitar que una sola persona, o un reducido conjunto de las mismas, ostente todo el poder de una nación. Llegado a ese punto es que nos empezamos a plantear si el esquema de división de poderes en nuestro estado resulta adecuadamente aplicado o si más bien cuenta con un sistema de diversas falencias creado, tal vez por interés particular de quienes gobernaban al emitir el texto constitucional de 1993, o tal vez por simplemente intentar copiar sistemas más avanzados sin observar el hibridaje natural de sus sistemas tradicionales. La presente investigación, en aplicación del método científico, así como diversas herramientas metodológicas busca lograr encontrar un punto concreto que permita dilucidar si el sistema de separación de poderes es o no eficiente o si este cumple o no con los parámetros esperados en un estado moderno, o más aún en estado constitucional de derecho.

The separation of powers is a vital element in every constitutional state of law, that is why, from the appearance of the theory of the modern state to the present day, states have tried to guarantee said liquidation of power, in order to prevent it from a single person, or a small group of them, holds all the power of a nation. At that point, we begin to consider whether the scheme of division of powers in our state is properly applied or whether rather it has a system of various flaws created, perhaps due to the particular interest of those who governed when issuing the constitutional text of 1993, or perhaps by simply trying to copy more advanced systems without observing the natural hybridization of their traditional systems. This research, in application of the scientific method, as well as various methodological tools, seeks to find a specific point that allows us to elucidate whether or not the system of separation of powers is efficient or whether or not it meets the expected parameters in a modern state. or even more so in a constitutional state of law.
