Principio de Interés superior del niño y la valoración de la conducta parental en los casos de tenencia compartida en el distrito judicial de Piura 2021-2023

Abstract

La presente tesis tiene como propósito establecer como incide en el Principio de Interés superior del niño la valoración de la conducta parental en los casos de tenencia compartida en el distrito judicial de Piura 2021-2023, para lo cual tiene una tesis de tipo aplicado y de diseño descriptivo-explicativo y se ha procedido a la técnica del análisis de casos, de lo cual se ha podido concluir que en el Principio de Interés superior del niño incide significativamente la valoración de la conducta parental en los casos de tenencia compartida en el distrito judicial de Piura 2021-2023, siempre que el juez acuda a criterios de razonabilidad y proporcionalidad y si ambos padres se encuentran mental, moral y económicamente aptos para sostener la tenencia compartida de sus hijos, si existen desavenencias de difícil resolución entre ambos padres, y toda circunstancia que ponga en peligro los derecho del menor, como sujeto cualificado de protección por parte del Estado, a través del Principio de Interés Superior del Niño.

of the Best Interest of the Child, for which it has an applied thesis with a descriptive- explanatory design and the case analysis technique has been used, from which it has

been concluded that the Principle of the Best Interest of the Child is significantly affected by the assessment of parental conduct in cases of shared custody in the judicial district of Piura 2022-2023, provided that the judge resorts to criteria of reasonableness and proportionality and if both parents are mentally, morally and economically fit to maintain shared custody of their children, if there are disagreements that are difficult to resolve between both parents, and any circumstance that endangers the rights of the minor, as a qualified subject of protection by the State, through the Principle of the Best Interest of the Child.
