La interpretación administrativa del Tribunal Registral en la elección del régimen patrimonial en unión de hecho frente al debido procedimiento administrativo

Abstract

El título de la tesis: “La interpretación administrativa del Tribunal registral en la elección del régimen patrimonial en unión de hecho frente al debido procedimiento administrativo”, inspira el desarrollo de la investigación de tipo no experimental con enfoque cualitativo que alcanzó el resultado de que la interpretación administrativa del Tribunal Registral es válida jurídicamente apoyada en un aspecto competencial expreso en la normativa, respecto a funciones de control de legalidad y la unificación de criterios. Luego respecto al régimen patrimonial de la unión de hecho, la remisión legal a la sociedad de gananciales no configura un modelo rígido ni excluyente de la posibilidad de que los convivientes puedan elegir el régimen. Ahora bien, sobre el debido procedimiento administrativo incorpora pautas que exigen la motivación clara e inteligible para que el administrado comprenda las razones de la decisión, que ha de ser suficiente la motivación al abordar el núcleo del conflicto y no se reduzca a formulas rituales. Finalmente, la interpretación del Tribunal Registral concibe a la sociedad de gananciales como régimen supletorio y no rígido, mostrando compatibilidad con los principios, pero presenta la necesidad de motivación concreta y casuística para dejar en claro la ponderación de los derechos en juego y la protección de la vulnerabilidad de los sujetos intervinientes y terceros.

The thesis title, “The Administrative Interpretation of the Registry Court in the Choice of Property Regime in De Facto Unions in Relation to Due Administrative Procedure,” inspired the development of this non-experimental, qualitative research. The study concluded that the Registry Court's administrative interpretation is legally valid, supported by an express provision of competence in the regulations regarding its functions of legality control and the unification of criteria. Furthermore, regarding the property regime of de facto unions, the legal reference to community property does not constitute a rigid model that excludes the possibility for cohabiting partners to choose their own regime. However, concerning due administrative procedure, the thesis incorporates guidelines that require clear and intelligible justification so that the individual concerned understands the reasons for the decision. The justification must be sufficient to address the core of the conflict and not be reduced to mere ritualistic formulas. Finally, the Registry Tribunal's interpretation views the community property regime as a supplementary, not rigid, system, demonstrating compatibility with the principles. However, it highlights the need for specific, case-by-case justification to clarify the balancing of the rights at stake and the protection of the vulnerability of the parties involved and third parties.
