Derecho a la igualdad ante la ley de las personas vulnerables solicitantes de asilo en el Perú

Abstract

Esta investigación tuvo como objetivo proponer una ley para atender prioritariamente las solicitudes de asilo de las personas vulnerables para garantizar el derecho a la igualdad ante la ley, investigación de tipo básica, utilizando el enfoque cualitativo, siendo las técnicas utilizadas el fichaje, análisis documental y encuesta. Instrumentos la ficha de datos, guía de análisis documental y encuesta realizada a 30 abogados especialistas en Derecho Constitucional. De los resultados se advierte que el derecho de asilo en el Perú ha tenido constantes modificaciones normativas, evidenciándose un inadecuado tratamiento a quienes son personas vulnerables. En razón a ello se determinó la necesidad de atenderlos de forma prioritaria para garantizar su derecho a la igualdad ante la ley. Se concluye que, Si se emite una ley para atender prioritariamente las solicitudes de asilo de las personas vulnerables, entonces se garantiza su derecho a la igualdad ante la ley.

The objective of this research was to propose a law to prioritize asylum requests from vulnerable people to guarantee the right to equality before the law, basic type research, using the qualitative approach, being the techniques used the signing, documentary analysis and poll. Instruments: the data sheet, documentary analysis guide and survey of 30 lawyers specializing in Constitutional Law. From the results it is noted that the right to asylum in Peru has had constant regulatory changes, evidencing inadequate treatment of those who are vulnerable. Because of this, the need to attend to them as a priority to guarantee their right to equality before the law will continue. It is concluded that, if a law is issued to give priority to the asylum requests of vulnerable people, then their right to equality before the law is guaranteed.
