dc.description.abstractLa presente investigación aborda un tema importante y sensible en el Derecho Civil Peruano, debido a la necesidad de proteger los derechos patrimoniales y sobre todo poder garantizar el principio del interés superior del niño. En nuestro código civil peruano, el artículo 448 es el que regula la autorización judicial para celebrar actos en nombre del menor. Asimismo, el artículo 109 del Código de los Niños y Adolescentes establece que quienes administran los bienes de niños y adolescentes deben obtener autorización judicial cuando se quiera disponer de ellos o gravarlos, siempre que exista una causa justificada de necesidad o utilidad. Sin embargo, en la practica judicial, dicho procedimiento para obtener la autorización presenta diversas limitaciones, las cuales están relacionadas con la sobrecarga procesal de los Juzgados de Familia. En consecuencia, ello genera retraso y demora indebida en procesos que, por ser de naturaleza no contenciosa, deberían resolverse de manera rápida y eficaz. En distritos judiciales como Lambayeque, estas demoras afectan de manera significativa al interés superior del niño, ya que ellos requieren disponer de sus bienes para atender necesidades urgentes las cuales son económicas, educativas, de salud o vivienda. Frente a este problema, muchos países de América Latina se han inclinado por la des judicialización de determinados asuntos no contenciosos, y han otorgado dicha competencia a los notarios públicos para autorizar la disposición de bienes de menores o incapaces. Tal es el caso de Colombia y Guatemala, cuyos marcos normativos establecen y reconocen a la función notarial como un mecanismo eficaz 5 y seguro para la tutela de estos derechos patrimoniales. En el contexto peruano, se puede colegir que mediante la Ley N° 26662, los notarios ya ejercen competencias similares, tal es la sucesión intestada y la rectificación de partidas, lo que permite evidenciar la posibilidad de aumentar su ámbito de aplicación. Esta investigación pretende analizar la viabilidad jurídica de incorporar el trámite notarial para autorizar la disposición de bienes de menores e incapaces, como una opción que permita resguardar los derechos patrimoniales y a la par, reducir la carga procesal en los Juzgados de Familia. La hipotesis es que la intervención notarial mediante un proceso mas célere y eficaz, podría garantizar se respete el interés superior del niño. El estudio se realiza a través de un enfoque descriptivo, se sustenta en el análisis normativo, doctrinario y comparado, así como en la aplicación de encuestas a operadores jurídicos, con el propósito de proponer una modificación legislativa que mejor nuestro ordenamiento jurídico y social.es_PE
dc.description.abstractThe present research addresses an important and sensitive issue within Peruvian Civil Law, due to the need to protect patrimonial rights and, above all, to guarantee the principle of the best interests of the child. In the Peruvian Civil Code, Article 448 regulates judicial authorization to perform legal acts on behalf of minors. Likewise, Article 109 of the Code of Children and Adolescents establishes that those who administer the property of children or adolescents require judicial authorization to encumber or dispose of such assets for justified reasons of necessity or utility. However, in judicial practice, the procedure to obtain such authorization presents several limitations, mainly related to the procedural overload of Family Courts. As a result, this situation generates delays and undue postponements in proceedings that, due to their non-contentious nature, should be resolved promptly and efficiently. In judicial districts such as Lambayeque, these delays significantly affect the best interests of the child, as minors need to dispose of their assets in order to meet urgent economic, educational, health, or housing needs. In response to this problem, several Latin American countries have opted for the dejudicialization of certain non-contentious matters, granting notaries public the authority to authorize the disposition of assets belonging to minors or legally incapacitated persons. Such is the case of Colombia and Guatemala, whose legal frameworks recognize the notarial function as an effective and secure mechanism for the protection of patrimonial rights. In the Peruvian context, it can be inferred 7 that, through Law No. 26662, notaries already exercise similar powers, such as intestate succession proceedings and the rectification of civil registry records, which demonstrates the possibility of expanding their scope of authority. This research aims to analyze the legal feasibility of incorporating the notarial procedure for authorizing the disposition of assets belonging to minors and incapacitated persons, as an option that would protect patrimonial rights while simultaneously reducing the procedural burden on Family Courts. The hypothesis is that notarial intervention, through a faster and more efficient procedure, could ensure effective respect for the best interests of the child. The study adopts a descriptive approach and is based on normative, doctrinal, and comparative analysis, as well as surveys conducted among legal practitioners, with the purpose of proposing a legislative amendment that would improve the legal and social framework of the Peruvian legal system.es_PE
