La fiscalización laboral de Sunafil y la formalización de trabajadores en el departamento de Lambayeque, 2023

Abstract

La presente investigación tuvo como objetivo analizar la fiscalización laboral ejercida por la Superintendencia Nacional de Fiscalización Laboral (SUNAFIL) y su relación con la formalización de trabajadores en el departamento de Lambayeque. El estudio se desarrolló bajo un enfoque cualitativo, con un diseño fenomenológico, utilizando como técnicas de recolección de información la entrevista a especialistas en derecho laboral y el análisis documental de las órdenes de inspección generadas por la SUNAFIL durante el año 2023. Los resultados evidencian que la fiscalización laboral constituye un mecanismo relevante para inducir la regularización de obligaciones sociolaborales, particularmente en lo referido al registro en planillas y otros aspectos formales del empleo. Asimismo, el estudio permitió identificar limitaciones operativas y de gestión vinculadas a la distribución de la fuerza inspectiva, la cobertura territorial y sectorial, y la continuidad del procedimiento inspectivo, las cuales condicionan la efectividad y sostenibilidad de la fiscalización laboral. En atención a estos hallazgos, se formuló una propuesta de intervención orientada a fortalecer la gestión de la fiscalización laboral, promover una formalización más sostenida y superar el enfoque meramente sancionador de la actuación inspectiva. Se concluye que el fortalecimiento de la fiscalización laboral resulta clave para avanzar hacia una mayor protección de los derechos laborales y la reducción progresiva de la informalidad en el ámbito regional.

The objective of this research was to analyze the labor inspection carried out by the National Superintendency of Labor Inspection (SUNAFIL) and its relationship with the formalization of workers in the department of Lambayeque. The study was conducted using a qualitative approach with a phenomenological design, employing interviews with labor law specialists and documentary analysis of inspection orders issued by SUNAFIL during 2023 as data collection techniques. The results show that labor inspection is an important mechanism for inducing the regularization of social and labor obligations, particularly with regard to payroll registration and other formal aspects of employment. The study also identified operational and management limitations related to the distribution of the inspection force, territorial and sectoral coverage, and the continuity of the inspection procedure, which condition the effectiveness and sustainability of labor inspection. In light of these findings, an intervention proposal was formulated aimed at strengthening the management of labor inspection, promoting more sustained formalization, and overcoming the purely punitive approach to inspection. It is concluded that strengthening labor inspection is key to advancing toward greater protection of labor rights and the progressive reduction of informality in the region.
