Esta investigación se centra en evaluar qué tan eficaz es realmente el marco legal del
lavado de activos cuando se enfrenta al crimen organizado en Piura (2022-2024). El punto de
partida es una contradicción evidente: aunque las leyes peruanas han avanzado hacia una
autonomía total del delito, tanto en lo sustantivo como en lo procesal, existe una brecha
preocupante cuando se intenta desarticular el músculo financiero de las mafias en la práctica
judicial regional. En ese marco, se busca determinar si el régimen vigente responde de manera
eficaz a las exigencias del contexto regional, examinando cómo se aplica la autonomía del
delito en las sentencias emitidas, cuáles son las principales dificultades dogmáticas y procesales
que inciden en su persecución penal y qué lineamientos podrían fortalecer tanto la regulación
normativa como la política criminal en esta materia.
La investigación adopta un enfoque cualitativo-básico con alcance descriptivo-
explicativo. Se emplea el método dogmático y la hermenéutica jurídica para el análisis
normativo y jurisprudencial, bajo procesos inductivos y sintético - deductivos. Las técnicas
comprenden el análisis de investigaciones fiscales, mediante triangulación cualitativa para
garantizar el rigor de los hallazgos. This thesis analyzes the level of effectiveness of the legal framework governing the
crime of money laundering in the fight against organized crime in the judicial district of Piura
during the period 2022–2024. The research problem focuses on the existence of a gap between
the normative development of the crime of money laundering, characterized by its substantive
and procedural autonomy, and the limited results obtained in judicial practice to economically
dismantle criminal organizations. The general objective is to determine whether the current
legal framework is effective in addressing organized crime, while the specific objectives aim
to analyze the application of the autonomy of the crime in judicial rulings, identify dogmatic
and procedural deficiencies that hinder its prosecution, and propose regulatory and criminal
policy guidelines to strengthen its effectiveness. The research adopts a qualitative approach,
with a basic type and a descriptive-explanatory level, using dogmatic, hermeneutic, inductive,
and synthetic-deductive methods. The techniques employed include documentary analysis of
judicial decisions and semi-structured interviews with specialists, applying qualitative
triangulation for data analysis. The results show that the level of effectiveness of money
laundering regulations in Piura is deficient, mainly due to restrictive interpretations of the
autonomy of the crime, evidentiary difficulties in proving the illicit origin of assets, and limited
application of asset-based measures aimed at economically neutralizing organized crime,
thereby reducing the deterrent capacity of the criminal justice system and justifying the need
for regulatory and criminal policy reforms.
