La presente investigación tuvo como objetivo general determinar cuál debe ser el
tratamiento jurídico de la figura del agente revelador en su articulación con el
proceso especial de colaboración eficaz en el ordenamiento procesal penal peruano.
El estudio se desarrolló bajo un enfoque cualitativo, de tipo básico, con nivel
descriptivo - explicativo y diseño no experimental; para lo cual se emplearon como
técnicas la entrevista semiestructurada y el análisis documental; la muestra estuvo
conformada por diez operadores jurídicos especializados en materia penal, entre
fiscales, juez, defensores públicos y docente universitaria. Los resultados
evidenciaron que el agente revelador constituye una técnica especial de
investigación, distinta del colaborador eficaz, aunque ambas figuras comparten una
relación funcional al permitir obtener información desde el interior o cercanía de
organizaciones criminales. Se concluyó que la regulación actual resulta insuficiente
para evitar zonas grises entre técnica investigativa y mecanismo premial, por lo que
se requiere una articulación normativa basada en legalidad, trazabilidad,
corroboración, control fiscal y judicial, y reconducción obligatoria a colaboración
eficaz cuando exista expectativa de beneficio. This research aimed to determine the appropriate legal treatment of the revealing
agent and its articulation with the special effective collaboration process within the
Peruvian criminal procedural system. The study followed a qualitative approach,
basic type, descriptive-explanatory level, and non-experimental design. Semi-
structured interviews and documentary analysis were used as research techniques.
The sample consisted of ten legal practitioners specialized in criminal law,
including prosecutors, a judge, public defenders, and a university professor. The
findings showed that the revealing agent is a special investigative technique, legally
different from the effective collaborator, although both figures share a functional
relationship because they may provide information from within or near criminal
organizations. The study concluded that the current regulation is insufficient to
prevent grey areas between investigative techniques and reward-based mechanisms.
Therefore, a normative articulation is required, based on legality, traceability,
corroboration, prosecutorial and judicial control, and mandatory referral to the
effective collaboration process whenever there is an expectation of criminal,
procedural, or penitentiary benefit.
