La interpretación normativa de las objeciones en juicio oral: discrecionalidad judicial y la seguridad jurídica en el proceso penal peruano
Resumen
El título de esta investigación “La interpretación normativa de las
objeciones en juicio oral: discrecionalidad judicial y la seguridad jurídica en
el proceso penal peruano”, inspiró a su desarrollo cualitativo en el análisis
para establecer que las objeciones en el juicio oral penal son instrumentales e
inmediatas, que activa la conducción del debate y controla tanto forma como
admisibilidad de los cuestionamientos y contenidos de prueba operativizando
la contradicción, la defensa, la igualdad de armas como garantías. Es
importante que se utilice la doctrina que integre la dogmática procesal, la
teoría de la prueba y la teoría de argumentación, asi la objeción funciona
como mecanismo efectivo de seguridad jurídica para estabilizar el criterio y
reducir la injustificada variación y alcanzar discrecionalidad en función al
debido proceso y sus estándares. Además de ello se considera que la
discrecionalidad se compatibiliza con la seguridad jurídica; al respecto la
evaluación jurisprudencial deja en claro que en el caso de las objeciones la
interpretación aplicada altera la seguridad jurídica y en la discrecionalidad del
juicio oral, si la decisión es implícita, variable o se controla de manera
exclusiva a la oportunidad y destreza de la defensa sin constancia o
fundamentación adecuada, termina por ampliarse la discrecionalidad opaca lo
cual favorece variaciones injustificadas entre casos análogos, afectando la
confianza en la igualdad de armas y la corrección del proceso The title of this research, “The Normative Interpretation of Objections
in Oral Trials: Judicial Discretion and Legal Certainty in the Peruvian
Criminal Process,” inspired its qualitative analysis, establishing that
objections in oral criminal trials are instrumental and immediate, activating
the conduct of the debate and controlling both the form and admissibility of
the challenges and the content of the evidence, thus operationalizing the
principles of adversarial proceedings, defense, and equality of arms as
guarantees. It is important to utilize a doctrine that integrates procedural law,
the theory of evidence, and the theory of argumentation, so that objections
function as an effective mechanism of legal certainty, stabilizing the criteria
and reducing unjustified variation, while achieving discretion based on due
process and its standards. Furthermore, it is considered that discretion is
compatible with legal certainty. In this regard, jurisprudential evaluation
makes it clear that, in the case of objections, the applied interpretation
undermines legal certainty. Furthermore, in the discretionary power of the
oral trial, if the decision is implicit, variable, or solely based on the
opportunity and skill of the defense without adequate evidence or
justification, it ultimately expands opaque discretion, which favors
unjustified variations between analogous cases, affecting confidence in
equality of arms and the fairness of the process.
