Valoración de la prueba por indicios en TID y la presunción de inocencia en el distrito judicial de Lambayeque, 2024

Abstract

La presente investigación titulada “VALORACIÓN DE LA PRUEBA POR INDICIOS EN TID Y LA PRESUNCIÓN DE INOCENCIA EN EL DISTRITO JUDICIAL DE LAMBAYEQUE, 2024”, tiene como objetivo general establecer los criterios que se están aplicando para valorar la prueba por indicios en el tráfico ilícito de drogas ilícitas, y desvirtuar la presunción de inocencia del acusado, en el distrito judicial de Lambayeque, en el año 2024. La investigación realizada es básica, descriptivo simple no experimental, y de enfoque cuantitativo, por cuanto su realización se orienta a un aspecto teórico y práctico, con la finalidad de aportar conocimientos especializados en la materia a estudiarse, siendo en el presente caso sobre la “prueba por indicios” o “valoración de los indicios” y la “presunción de inocencia” del acusado en los procesos penales de TID. Por ello, se recolecto una información de manera individual y conjunta, sobre las variables estudiadas en la investigación. Por lo que en primer lugar se describirá desde un aspecto teórico sobre la valoración de la prueba por indicios y la presunción de inocencia en el proceso penal; posteriormente, se analizará el aspecto normativo (estructura) del tráfico ilícito de drogas (TID). Luego, se analizará los criterios que está aplicando la CSJ para valorar los indicios en el TID, y como influye para que la presunción de inocencia del acusado sea desvirtuada; así mismo, se examinara los criterios jurídicos que se han aplicado sobre el tema en investigación, en el distrito judicial de Lambayeque, en el 2024. Por último, se propondrá los criterios que se deben aplicar para la valoración de la prueba por indicios en el tráfico ilícito de drogas, con la finalidad que la presunción de inocencia del acusado sea enervada en estricto cumplimiento de un debido proceso, en el distrito judicial de Lambayeque, en el año 2024. Por lo tanto, mediante la presente investigación se contribuye conocimientos de la materia investigada para comprenderla mejor, en aras, de conocer, que criterios se están aplicando para valorar la prueba por indicios en el tráfico ilícito de drogas ilícitas, y desvirtuar la presunción de inocencia del acusado, en el distrito judicial de Lambayeque, en el año 2024.

The present investigation entitled “ASSESSMENT OF THE EVIDENCE BY INDICATIONS IN TID AND THE PRESUMPTION OF INNOCENCE IN THE JUDICIAL DISTRICT OF LAMBAYEQUE, 2024”, has as a general objective to establish the criteria that are being applied to evaluate the evidence by indications in the illicit trafficking of illicit drugs, and to distort the presumption of innocence of the accused, in the judicial district of Lambayeque, in the year 2024. The research carried out is basic, simple descriptive, non-experimental, and quantitative in approach, since its implementation is oriented towards a theoretical and practical aspect, with the purpose of providing specialized knowledge in the subject to be studied, in the present case being about the “proof by evidence” or “assessment of the evidence” and the “presumption of innocence” of the accused in DID criminal proceedings. For this reason, information was collected individually and jointly on the variables studied in the research. Therefore, firstly it will be described from a theoretical aspect regarding the evaluation of evidence based on evidence and the presumption of innocence in the criminal process; Subsequently, the regulatory aspect (structure) of illicit drug trafficking (IDT) will be analyzed. Then, the criteria that the CSJ is applying to evaluate the evidence in the TID will be analyzed, and how it influences the presumption of innocence of the accused to be disproved; Likewise, the legal criteria that have been applied on the topic under investigation will be examined, in the judicial district of Lambayeque, in 2024. Finally, the criteria that must be applied for the evaluation of evidence based on indications in illicit drug trafficking will be proposed, with the aim that the presumption of innocence of the accused is weakened in strict compliance with due process, in the judicial district of Lambayeque, in the year 2024. Therefore, through this investigation, knowledge of the subject investigated is contributed to better understand it, in order to know what criteria are being applied to evaluate the evidence based on evidence in the illicit trafficking of illicit drugs, and to disprove the presumption of innocence of the accused, in the judicial district of Lambayeque, in the year 2024.
