The aim of the study was to establish the reasons that justify the recognition of related
relatives of common-law unions as subjects of protection in Law 30364, Contumazá,
2023. It used a qualitative, applied, descriptive and propositional methodology, with a
non-experimental design. As a result, it was found that it is necessary to recognize
related relatives of de facto unions as subjects of protection in Law 30364 in order to
guarantee their right to comprehensive assistance and protection, showing that this
strengthens the legal framework of comprehensive protection and ensures that all
vulnerable people within the family nucleus, regardless of the type of union, receive
protection from violence. This incorporation would allow for a fairer and more effective
application of the law, avoiding restrictive interpretations and ensuring that all persons
at risk of violence can receive protection regardless of the type of family relationship.
Benefits include greater protection against domestic violence, access to preventive and
corrective measures, and the strengthening of the concept of family in its diversity,
promoting equality before the law. It is concluded that the reasons that justify the
recognition of related relatives of common-law unions as subjects of protection in Law
30364 are that they share a domestic and affective environment with the nucleus of the
common-law union; the protection seeks to prevent family violence, without limiting
itself to blood relations; it responds to the need to protect all those who may be
vulnerable within this environment, play roles of support and care, so that their
exclusion would leave people who may be vulnerable to violence unprotected.
