El desistimiento tácito en el proceso de faltas: a propósito de su aplicabilidad en la falta de maltrato contra la mujer e integrantes del grupo familiar

Abstract

El presente estudio tiene como propósito analizar la problemática actual relativa a la discusión jurisprudencial, doctrinaria y legislativa respecto a si procede aplicar supletoriamente el desistimiento tácito; establecido en los artículos 110° y 462° inciso 5 del Código Procesal Penal para el querellante particular, en los casos de faltas por maltrato mediante violencia familiar y lo establecido en el artículo 442° del Código Penal, en mérito al Principio de Lesividad, para ello, se analizarán resoluciones emitidas en los Juzgados de Paz Letrado de Utcubamba – Amazonas respecto a los procesos por faltas contra la mujer e integrantes del grupo familiar, de los años 2018-2019, en donde se contrasta la inconcurrencia no justificada de la parte agraviada a la audiencia para el proceso de faltas y se examine la forma en la que ha resuelto el juez ante dichas circunstancias, esto es, si se configura o no el desistimiento tácito.

The purpose of this study is to analyze the current problems related to the jurisprudential, doctrinal and legislative discussion regarding whether it is appropriate to apply the tacit withdrawal in addition; established in CPP articles 110 and 462, subsection 5 for the private plaintiff; In cases of misconduct due to mistreatment through family violence, established in Article 442 of the Penal Code, in merit of the Principle of Lesividad, for this, resolutions issued in the Courts of the Peace Lawyer of Bagua Grande - Amazonas regarding the processes for offenses against women and members of the family group, for the years 2018- 2019, where the unjustified inconsistency of the aggrieved party is contrasted at the hearing for the fault process and the way in which the judge has resolved in said circumstances is examined, that is, if the tacit withdrawal is configured or not.
