Las infracciones funcionales en la carrera pública magisterial y la efectividad del debido procedimiento administrativo sancionador en la UGEL Lambayeque

Abstract

Esta investigación denominada: “Las infracciones funcionales en la carrera pública magisterial y la efectividad del debido procedimiento administrativo sancionador en la UGEL Lambayeque”, aplicando el método de análisis llegó a determinar que la tipificación de las infracciones funcionales en la Carrera Pública Magisterial además de delimitar el marco de la actuación de la administración también representa la base de la validez del procedimiento sancionador, evidenciándose que el debido procedimiento administrativo sancionador regido por la tipicidad, legalidad, proporcionalidad y razonabilidad, presenta fallas para ser implementado a razón de las dificultades de cada institución lo cual se reconoce por el incumplimiento de plazos, dispersión de criterios debilitando su eficacia real, existiendo tipificaciones ambiguas, deficientes o aplicadas de manera retroactiva, lo cual desde la perspectiva de UGEL Lambayeque muestra una brecha entre coherencia normativa y capacidad institucional real, afectando negativamente la efectividad del debido procedimiento administrativo sancionador.

This research, entitled "Functional Infractions in the Public Teaching Career and the Effectiveness of the Due Administrative Sanctioning Procedure at the Lambayeque UGEL," applied the analytical method. It determined that the classification of functional infractions in the Public Teaching Career, in addition to delimiting the scope of the administration's actions, also represents the basis for the validity of the sanctioning procedure. It is evident that the due administrative sanctioning procedure, governed by typification, legality, proportionality, and reasonableness, presents flaws in its implementation due to the difficulties of each institution. This is recognized by the failure to meet deadlines, the dispersion of criteria, weakening its real effectiveness, and the existence of ambiguous, deficient, or retroactively applied classifications. From the perspective of the Lambayeque UGEL, this reveals a gap between normative coherence and real institutional capacity, negatively affecting the effectiveness of the due administrative sanctioning procedure.
