La presente investigación titulada “Análisis del conflicto normativo entre los artículos penales de
sicariato, homicidio calificado por codicia y homicidio calificado por lucro en el Código Penal
Peruano” parte de la base de los análisis típicos de estos tres delitos a fin de poder determinar si
sus ámbitos de aplicación normativa se superponen, generando así un conflicto de tipificación
entre estas figuras penales. Se empieza el primer capítulo resumiendo los aspectos
metodológicos de la presente investigación para pasar luego al segundo capítulo en donde se
examina el tipo penal de sicariato, su etimología, sus elementos típicos, su autoría y participación
y, finalmente, su penalidad y sus agravantes. Posteriormente, en los capítulos tercero y cuarto se
examinan dogmáticamente los tipos penales de homicidio calificado por codicia y homicidio
calificado por lucro, regulados en el artículo 108 inciso 1 del código sustantivo.
El capítulo quinto, luego del estudio dogmático, se efectúa un análisis comparativo entre el delito
de sicariato y los delitos de asesinato por lucro y asesinato por codicia, demostrando sus
diferencias conceptuales y sus límites dogmáticos, identificando los aspectos en los cuales se
diferencian y superponen estos tres delitos.
El capítulo sexto desarrolla un estudio jurisprudencial analizando las sentencias emitidas por la
Corte Suprema de la República respecto a estos tres delitos, analizando el tratamiento que esta
alta jurisdicción da a partir de la dación del delito de Sicariato mediante el D.L. N° 1181, de
fecha 27 de julio de 2015, los criterios utilizados y las diferencias dogmáticas y conceptuales
que, a través de esta jurisprudencia relevante, permiten definir los alcances típicos y los ámbitos
de aplicación de estos tres delitos.
Finalmente, en el capítulo séptimo se efectúa una revisión de legislación comparada, analizando
los códigos sustantivos de los países de América Latina y España a fin de verificar si existen en
ellos conflictos como los presentados en el código penal o si dan tratamientos diferenciadores
para los delitos materia de la presente investigación.
En conclusión, la presente investigación fue desarrollada a fin de determinar si existe algún
conflicto normativo entre el delito de sicariato y los delitos de homicidio calificado por lucro y
por codicia, y una vez definido ello proponer como solución a dicho conflicto una reformulación
legislativa a fin de evitar la duplicidad punitiva y la incertidumbre jurídica, garantizando los
principios de legalidad y tipicidad en el sistema penal peruano. This research entitled “Review of Normative Conflict between the Penal Code Crimes of
Contract Killing, Homicide by Greed and Homicide by Profit in the Peruvian Penal Code”, is
based on typical analyses of these three crimes in order to determine whether their scopes of
application overlap, thus generating a conflict of classification between these criminal offenses.
The first chapter begins by summarizing the methodological aspects of this research, followed by
the second chapter, which examines the crime of contract killing, its etymology, its typical
elements, authorship and participation, and finally, its penalties and aggravating circumstances.
Subsequently, the third and fourth chapters examine, from a dogmatic perspective, the crimes of
homicide aggravated by greed and homicide aggravated by profit, regulated in Article 108,
paragraph 1 of our substantive code.
Chapter Five, after the dogmatic study, carries out a comparative analysis between the
crime of contract killing and the crimes of murder for profit and murder for greed, demonstrating
their conceptual differences and their dogmatic limits, identifying the aspects in which these
three crimes differ and overlap.
Chapter Six develops a jurisprudential study analyzing the judgments issued by the
Supreme Court of the Republic regarding these three crimes, analyzing the treatment that this
high jurisdiction gives from the granting of the crime of Contract Killing through D.L. No. 1181,
dated July 27, 2015, the criteria used and the dogmatic and conceptual differences that, through
this relevant jurisprudence, allow defining the typical scopes and the areas of application of these
three crimes.
Finally, in chapter seven a review of comparative legislation is carried out, analyzing the
substantive codes of the countries of Latin America and Spain in order to verify if there are
conflicts in them like those presented in our penal code or if they give different treatments for the
crimes subject to this investigation.
In conclusion, this research was developed to determine if there is any normative conflict
between the crime of contract killing and the crimes of aggravated homicide for profit and greed,
and once this is defined, to propose as a solution to said conflict a legislative reformulation in
order to avoid punitive duplication and legal uncertainty, guaranteeing the principles of legality
and typicity in the Peruvian penal system.
